Senegal signs accord to try ex-Chadian dictator Habre

Senegal and the African Union on Wednesday signed an agreement in Dakar to create a special tribunal to try former Chadian dictator Hissene Habre who is accused of war crimes.

"Through the agreement, we are setting the procedure by which the trial should take place... there are no more obstacles," said Senegal's Justice Minister Aminata Toure after signing the agreement with African Union representative Robert Dossou.

"This is a big step... towards a fair trial. We lost a lot of time but the key thing is being done. We are moving resolutely towards the holding of the trial," she added.

Habre, whom the International Court of Justice ordered Senegal to try or extradite, has been living in Senegal since fleeing his country in 1990 after being ousted by president Idriss Deby Itno.

A 1992 truth commission report in Chad said that during his time in power, Habre presided over up to 40,000 political murders and widespread torture.

"The African Union is pleased that the principle of (fighting against) impunity is taking shape," said Dossou.

While mandated by the African Union to put Habre on trial in 2006, Senegal dragged its feet for years under president Abdoulaye Wade, citing problems in jurisdiction and then funding.

But events took on a new momentum last month when Senegal's new President Macky Sall -- unlike his stalling predecessor Wade - said at an African Union summit in Addis Ababa that he had a "strong commitment" to see Senegal try Habre.

After four days of talks in Dakar, a draft agreement was drawn up between the AU and the Senegalese government on the creation of extraordinary African chambers within the Senegalese court structure.

A Belgian investigating team that travelled to Chad in 2002 visited detention centres and mass graves and found thousands of documents from Habre's political police, providing strong evidence of torture and rights violations.

The chambers will have four sections to handle instruction, investigations, trials, and appeals, and will consist of Senegalese and other African judges.

In 2010 some 8.6 million euros ($10 million) was pledged by the European Union, Belgium, Germany, France, Luxembourg, the African Union and Chad for the holding of the trial.

However just weeks later Wade said he wanted to "get rid of" the case, and the money was never paid.

However, after meeting?one of her early mentors, Professor Stanley Lopes ? who inspired her to achieve and ?come up higher? Marsha?sparked a rapid change and she left school at 15 (a year early) to start college. Upon graduation she went on to study Management in Kent. ?At just 17, Marsha again advanced others at her age, when she started her first senior management role as a Commercial Manager in an ?Energy Brokerage? in Neasden.

In the 90?s, Marsha gained experience working and resigning from no less than fifteen different jobs from fast food to telemarketing ? jokingly she says she ?I could never keep a job?.

However ? this expereince was intergral to starting her first company aged just 18, in the publishing industry and incorporating a consultancy business at age 19.

By her early 20?s Marsha was strong in the property investment scene and in research following her studies in politics, sociology, business and investment strategies.

Now entering her thirties, Marsha is the CEO, VP and owner of?numerous ventures?internationally. She has grown to become seen as a business icon, a revolutionist in sales strategy and a mastermind in marketing tactics.

(AP) ? Aided by a shift in wind direction, firefighters made a stand against a huge lightning-sparked wildfire burning on the edge of three small Northern California towns.

The blaze, which grew to more than 25 square miles late Monday continued to threaten thousands of homes, as fearful residents sought safety miles away at an emergency shelter.

"All we can do is pray," evacuee Jerry Nottingham told reporters.

Still, with more firefighters arriving on the scene and shifting winds helping to keep the blaze away from homes, officials said fire crews were able to improve their lines around the wildfire.

"We definitely made some good progress today building around this fire," state fire spokesman Daniel Berlant said late Monday.

The fast-moving Ponderosa Fire was one of many burning across the West, where lightning, dry temperatures and gusting winds have brought an early start to fire season.

Nearly 1,900 firefighters were battling the blaze in rugged, densely forested terrain as it threatened 3,500 homes in the towns of Manton, Shingletown and Viola, about 170 miles north of Sacramento.

"These are the largest number of homes we've had threatened so far this year," state fire spokesman Berlant said. "The grass, brush and timber up here are so dry, and once the lightning with no rain struck, the flames began to spread quickly."

The fire has destroyed seven homes and was 30 percent contained after beginning Saturday.

Melted satellite dishes, the remains of burned furniture and charred refrigerators could be seen in some homes in the rural area.

As the wildfire burned, massive amounts of smoke poured up from the forest.

The fire forced the closure of Highway 44 and other roads, and prompted the declaration of an emergency in Shasta County. The Red Cross set up an evacuation center at a sports complex in Redding, where dozens of people, from the elderly to infants, as well as about a dozen dogs, were given shelter.

One evacuee, Bonnie Maloy, who escaped her home in Shingleton, along with her husband Bill, described the scene as they fled the flames.

"Frantic at first, then I said, 'Let's calm down,' and we got everything that's important, things we couldn't replace: animals, kids, photo albums," she said.

Another massive wildfire burning to the south in Plumas National Forest since July 29 grew larger over the weekend as strong winds pushed the flames past fire lines established late last week.

The blaze, about 120 miles north of Sacramento, has consumed more than 79 square miles and was threatening about 900 homes. It was 37 percent contained.

Elsewhere in California, a wildfire in Lassen Volcanic National Park was 65 percent contained after consuming more than 43 square miles. Officials expected firefighters would have the blaze contained by Tuesday.

In Mendocino County, a wildfire that started Saturday had consumed about 9 square miles. That blaze was sparked by lightning and was burning in a remote area of thick timber and rugged terrain, making it difficult for fire crews to access.

In Idaho, firefighters dug in to defend the town of Featherville against the raging Trinity Ridge Fire that has chewed through more than 141 square miles in the central region of the state. Flames had yet to reach Featherville, which has been evacuated. But if they do, firefighters said they were ready with a planned burnout operation intended to slow the blaze.

A little to the north, Idaho's largest wildfire, the Halstead Fire, which was ignited by lightning in late July, had burned 143 square miles.

In Washington state, firefighters hoped to fully contain a wildfire that burned dozens of homes in Cle Elum, about 75 miles east of Seattle. Crews across the state expected thunderstorms that could bring moisture along with the possibility of lightning and additional fires.

The fire broke out a week ago at a bridge construction project and has burned nearly 36 square miles of grass, sagebrush and timber in rural areas. Most of Eastern Washington was under a fire watch Monday due to high temperatures and low humidity.

Smaller fires were burning in Colorado and Utah after being sparked by lightning over the weekend.

Oil stays above $96 on consumer confidence

BANGKOK (AP) ? Oil prices rose for a fifth straight day of gains Monday, on the back of rising consumer confidence in the U.S. economy.

Benchmark oil for September delivery rose 30 cents to $96.31 per barrel in midday Bangkok time in electronic trading on the New York Mercantile Exchange. The contract rose 41 cents to end at $96.01 per barrel on the Nymex on Friday.

Brent crude rose 53 cents to $114.24 on the ICE Futures exchange in London.

The Thomson Reuters/University of Michigan preliminary August index of consumer sentiment released Friday showed its highest level since May. Most economists had been expecting a decline.

That combined with surprisingly strong retail sales and housing data raised hopes that the world's No. 1 economy is gaining traction.

Ric Spooner, chief market analyst at CMC Markets in Sydney, said the rally may be nearing the end of its course, as prices "are pushing into what many people would regard as the higher end of the neutral range for oil."

"The market is fairly well covered at the moment in terms of supply capacity," he said. "We are getting to a stage where the risk is starting to look to the downside."

In other energy trading on the Nymex, heating oil rose 0.7 cents to $3.10 per gallon. Natural gas fell 1 cent to $2.71 per 1,000 cubic feet.

Mayor Bloomberg Breaks Ground on New Beacon High School








Mayor Bloomberg, Schools Chancellor Dennis M. Walcott and City Council Speaker Christine C. Quinn today broke ground on the new Beacon High School in Manhattan. The six-story building ? formerly a New York Public Library Annex ? will be completely renovated to accommodate more students and feature high-quality classroom resources including wireless internet access, state-of-the-art technology labs, a dark room, a black box theatre, music suite, library and exercise facility. An additional seventh floor will be built to provide a regulation-size, 7,500 square foot gymnasium and separate 432-seat auditorium.

The new, larger school will accommodate 1,487 students, including for special education District 75 students. The Mayor was joined at the groundbreaking in Midtown Manhattan by Council Member Gale Brewer, Beacon High School Principal Ruth Lacey, School Construction Authority President and CEO Lorraine Grillo, Department of Education CEO Jeffrey Shear, District 75 Superintendent Gary Hecht and Council Member Gale Brewer.

?Our public school students live in the most dynamic city in the world, and we are working to make sure our classroom match those resources,? said Mayor Bloomberg. ?The new Beacon High School building will offer Wi-Fi, science labs and arts suites to complement and support our students? innovation. Most importantly, it will provide more space for one of our most successful and growing high schools.?

?Today?s groundbreaking is the first step in providing even more resources to build on this school community?s interests and talents,? said Chancellor Walcott. ?We are so thrilled for the exciting opportunities this state-of-the-art campus will allow, and I want to thank the School Construction Authority for their work on this project.?

?In its new home, the Beacon High School will be able to continue its tradition of excellence while offering students many new, exciting and state-of-the-art resources,? said Speaker Quinn. ?We are thankful to everyone who worked to make this day possible and congratulations to all the students who will get to enjoy this wonderful new school.?

?The former library site will be completely gutted and rebuilt from the inside as we incorporate the latest environmentally friendly materials in design and construction,? said School Construction Authority President and CEO Grillo.

?This is a remarkable day for our students who will learn about science while conducting experiments in a state-of-the-art science lab and they will be introduced to various instruments and learn how to paint in new music and art classrooms,? Beacon High School Principal Ruth Lacey said.

The New York City School Construction Authority acquired the new Beacon High School site from the New York Public Library. The architecture firm John Ciardullo & Associates is responsible for the design, and the school is expected to open in September 2015.

The new school is a part of the Department of Education?s $11.3 billion Capital Plan. This September, the City will open 14 newly constructed or renovated school buildings to add 9,453 more student seats. In the last 10 years, the Bloomberg Administration has created 116,000 total student seats.

Israel vows to punish suspected Jew-on-Arab violence

Israel's government at the weekend harshly condemned two incidents in which Israeli Jews are suspected of having violently assaulted Palestinian Arabs, and vowed to swiftly bring the alleged perpetrators to justice.

Both incidents occurred on Thursday night last week. In the first, a firebomb was hurled at a Palestinian taxi, injuring six people inside the vehicle. Police suspect that the perpetrators were Jewish youth frustrated by years of Palestinian attacks on Jewish motorists.

Leaders of Jewish communities in Judea, where the attack took place, noted that Palestinians regularly attack Jewish motorists in the same area and insisted it was too early to determine if the perpetrators were Jews, or Arabs who mistakenly firebombed one of their own.

But Israeli authorities said they were convinced the attackers were Jews, and started questioning local teens known to be involved in "extremist" activities.

Most local Israelis condemned the attack, and empathized with the victims, but were sorely disappointed with the response of their government and the international community.

"Firebombings and rock attacks are part of daily life for Jewish residents of the area, and we have yet to hear of this kind of fast response and efficiency from the security forces in dealing with those incidents," one Israeli told Israel National News. "And here, when there?s just a whiff of a hint of a suspicion that Jews might have done it, we see how, starting from the top...everyone is determined and prepared to ?do everything to bring those responsible to justice.'"

The second incident took place in Jerusalem's Zion Square, where numerous reports state that a group of up to 12 Jewish youth clashed with three Arab teens, leaving one of the Arabs seriously wounded.

Details about how the beating began remain fuzzy, but what is known is that the result was an 18-year-old Arab boy being hospitalized at Jerusalem's Hadassah Ein Kerem Hospital suffering from serious head injuries.

On Friday, Prime Minister Benjamin Netanyahu phoned Palestinian leader Mahmoud Abbas to express his outrage over the attacks, and to swear he would do everything possible to bring those responsible to justice.

Minister for Strategic Affairs Moshe Ya'alon called the attacks acts of terrorism, and said it was "unbearable" and "aggravating" to see Jews violating their people's own moral standards.

News of the attacks, and the responses to them, were the topics of much discussion in Israel on Sunday. While the bulk of Israelis strongly condemned the violence and agreed that those responsible must be punished, many commenters on major news websites also pointed out the stark contrast between Israel's response to these attacks and the Palestinian response to similar Arab attacks against Jews, and why it does not bode well for genuine peace anytime soon.

The vast majority of Israelis have slammed last week's attacks and want to see justice done to the suspected Jewish perpetrators. That is especially true of the Israeli government and media. But when Palestinian Arabs attack Jews in similar fashion, the Palestinian media praises the perpetrators and the Palestinian Authority holds them aloft as heroes, particularly if they end up in an Israeli jail.

Stocks up slightly on strong retail results

Stocks resembled summer vacationers on Friday, rising not-too-impressively in the morning and then mostly laying around for the rest of the day.

Positive news from retailers was the main reason U.S. indexes posted small gains. Apple helped too by hitting a new high.

Traders in both the U.S. and Europe are on vacation, so volumes were low. And the dog days continued for Facebook. A 4 percent decline left it shares at about half the price of its May initial public offering.

The Dow Jones industrial average rose 25.09 points to close at 13,275.20. The Standard & Poor's 500 index rose 2.65 points to close at 1,418.16. The Nasdaq rose 14.20 points to close at 3,076.59.

The modest gains put some indexes close to their highs for the year. The Dow is now within four points of 13,279, its high for the year set on May 1. The S&P 500 is within one point of its four-year high set on April 1.

The Dow has now risen eight out of the last 11 days and finished the week up a half-percent. The Dow is sporting a gain for the year of almost 8.7 percent for the year, while the S&P 500 is up almost 12.7 percent.

Next week is likely to be more eventful. Investors will get Chinese housing reports, minutes from a closely-watched Federal Reserve meeting, and jobless claims. And Europe's problems, which were mostly off center stage in recent days, return front-and-center as German Chancellor Angela Merkel meets in Berlin with Greek Prime Minister Antonis Samaras to talk about progress in overcoming Greece's debt crisis.

"Next week, you have somebody say something that no one expects, in thin trading it could really move markets around," said John Canally, investment strategist at LPL Financial.

Strong retail earnings and outlooks drove Friday's gains. Gap Inc. shares rose 4.8 percent after it boosted its outlook and posted a 29 percent jump in net income. That suggests the operator of Gap, Old Navy and Banana Republic stores is finally on the way to a turnaround.

Shares of Ann Inc., the parent of retailer Ann Taylor, jumped 20 percent after its second-quarter profit rose 24 percent. Foot Locker rose 1.7 percent after quarterly profits leaped 59 percent, boosted by higher sales, cost controls and a small tax-related gain.

A few retailers did struggle. Sears Holdings Corp. fell 1.3 percent, giving back some of Thursday's big gain.

Expectations for retailers were low, but they beat them, said Lawrence Creatura, portfolio manager at Federated Investors.

"Nobody going into the summer expected a vibrant consumer, so expectations were muted," he said.

Technology stocks saw both highs and lows on Friday.

Apple hit an all-time high, rising almost 2 percent to $648.11. It now has a market value of about $608 billion, almost 50 percent higher than No. 2 Exxon Mobil Corp. at $408 billion.

But declines continued for Facebook and Groupon, the online coupon company.

Facebook closed at $19, about half the value of its initial public offering price of $38. Investors are worried that mobile ads won't bring in as much money as those seen on desktop computers. And Facebook's short-term problems include the expiration of a lock-up period on Thursday that had kept early investors from selling.

Groupon lost another 5 percent to close at $4.75. It has now set a new low every day since Tuesday. Its woes include foreign-exchange rates in Europe and a worry that its business isn't very hard for competitors to copy.

Health care stocks declined a half-percent, the biggest drop among the 10 industry groups in the S&P 500. Pharmaceutical companies led the decline. Pfizer fell 1 percent, and Merck dropped 1.4 percent.

Computer chip maker Marvell Technology Group Ltd. stock dropped 14 percent after a revenue decline sliced its quarterly net income by more than half. Its CEO cited a slowing economy for the trouble.

Global markets edged higher after German Chancellor Angela Merkel gave a new pledge of support for the euro. On Thursday she said that "we feel committed to do everything we can to maintain the common currency." Germany is Europe's economic powerhouse, so its support is critical to the euro's survival. The German DAX rose 0.6 percent.

Red Bulls and defender Ogunbiyi part ways

HARRISON, N.J. (AP) - The New York Red Bulls and defender Babajide Ogunbiyi have agreed to part ways.

The Red Bulls announced the move Friday, citing undisclosed concerns about the player's physical condition.

General manager Erik Soler said Ogunbiyi took a physical after being signed in late July and the team had some concerns. After consulting a number of doctors over the past two weeks, the team decided to let him go.

The Red Bulls refused to comment on the medical issue, citing the player's right to confidentiality.

Ogunbiyi had played with Viborg FF of the Danish First Division since 2010.

Equity Research Firms and Foreign Investors Take on India Bulls

Shareholder activism has never really taken hold in India. Annual general meetings have been occasions for praising the chairman and the company management, asking for higher dividends, having tea and going home. But ever since an analyst at Kotak Securities started the unraveling of Satyam Computers by questioning why the company was keeping US$550 million in current accounts, equity research firms and foreign investors have begun taking on the role of defenders of the lay investor.

In March of this year, it was U.K.-based The Children?s Investment Fund Management ? an investor in Coal India Ltd ? which threatened to sue the company?s management for giving in to the Indian government?s demands on coal pricing and, in the process, ignoring the interests of its own shareholders. Then it was the equities research arm of Australian bank Macquarie questioning the accounting policies of HDFC, India?s largest housing finance company and one of the most respected firms in the country. Now, it is a report by Veritas Investment Research of Canada that has created quite a storm.

The latest Veritas target is the Gurgaon-based Indiabulls Group. In a report titled ?Bilking India,? dated August 1 but released later, the research firm contended that Indiabulls management had thrown corporate governance to the wind to enrich a select group of shareholders. ?We believe that disclosures at Indiabulls Real Estate Ltd (IBREL) and Indiabulls Power Ltd are unreliable and that the sole purpose of IBREL is to bilk institutional and retail investors for the benefit of select insiders,? says the report. ?The controlling shareholders are running the organization as a piggybank, while proclaiming propriety and espousing credibility.? The report warns Indian financial institutions that lend to the group to ?watch out? and advises investors to ?sell all Indiabulls Group stocks.?

In June, Veritas had come out with another report ? titled ?A House of Cards? ? questioning the accounting policies of Reliance Communications (RCom). RCom management responded by saying that the report was ?sensational? and reflected Veritas? complete lack of understanding of RCom?s assets and businesses. ?Veritas is systematically working to destroy confidence in Indian capital markets through sensationalist reports,? said RCom.

The Indiabulls management has gone beyond a mere verbal denial. It has issued full-page advertisements in the newspapers giving its side of the picture. It has disputed the numbers and the analysis. ?The heavy bias for creating sensationalism for personal profiteering is the reason [for the report],? alleges the company. The firm has filed a police complaint against the Veritas analysts. The police, in turn, have issued summons to the Canada-based analysts for a personal appearance. Indiabulls has produced emails which are claimed to show that Veritas asked for money to delay publication of the report.

Nothing is likely to happen to Veritas, however; the law in India moves very slowly. But Indiabulls Group shares have plunged on the stockmarkets. Indiabulls Financial Services, for instance, is down to Rs. 190 (around US$3.40) from its 52-week high of Rs. 267 (US$4.60). Meanwhile, Morgan Stanley Singapore bought 10.1 million shares of Indiabulls Infrastructure & Power at the height of the controversy. The purchase was made at Rs. 6.17 per share. It is now quoted at Rs. 5.

How To Study Better And Smarter

Through studying, we are able to gather new information and learn new things. It is important that a student studies well so that he could get the most out of his education. When a student studies better, he can have a better future ahead. Nonetheless, there are instances when there are hurdles and obstacles that a student needs to overcome in order to learn the things he must learn. A student should know how he can study better and smarter, instead of harder.
The place for studying affects your efficiency in studying.
? The study place you need to choose is one that is available to you each time that you need it. If you share the place with someone else, set a schedule when you can both use the area effectively.
? The place must also be free from distractions. An hour of distraction-free study is always better than four hours study filled with interruptions.

Mobile phone should be turned off or muted. If you are using a computer, make sure that you also turn the chat feature off, unless you use IM to communicate with a study group. You should not check e-mails while studying.
? The place should have every necessary material for studying. The materials you would need are references, paper and school supplies. Make sure that all these things are at hand where you choose to study.
? Your study place also needs to have a table or desk where you can spread out all the things needed for studying. The desk should also give you adequate space for writing. Try to be organized on your desk. Along with the desk is a comfortable chair. The chair should not make you fidget or feel stiff while sitting and studying. Do not choose a chair that is too comfortable it will make you want to sleep.
? The study area must also have adequate lighting. If the room is too dim, you will strain to see the pages of a book; this can quickly drain your energy and hurt your eyesight. If in a dark room, you can use a reading light or a shade.
? It also needs to have a comfortable temperature conducive for studying. It should not be too warm or too cold. If it is air-conditioned, choose a temperature ideal for you.
Your Time for studying also influences your efficiency.
? You need to set a schedule for studying that you can always follow. Studying time must be made into a routine that your body will follow automatically.
? Choose the days or the times when you are most energetic. Assignments should also be completed before going to your class.
? Study at daytime whenever possible. From studies and research, it was found out that studying for 60 minutes at daytime is equal to 90 minutes of studying at night.
? There are also time durations that will work best on the type or style of studying you need to do. In general, a one hour studying is the most effective; with 10 minutes for break and 50 minutes for studying. If you need to memorize and study your notes, shorter periods are best. For writing papers and solving problems, longer times are needed.
? If possible, study right after the lecture so that you can retain all information in your mind effectively.
? Prioritize which subjects or tasks you need to accomplish first and learn to manage your study time well.

After School Activities | Alamo Area Kids & Family

These days, children seem to grow up far too fast. With all the social media and intense video games, some kids sadly do not have the chance to experience the childhood we remember. When your child comes home from school, try to have other activities for them to engage in rather than sitting by a computer or TV screen.
What interests your child? Do they enjoy acting, singing or any sports? If they have a passion for any of these, find an after school club they can join where they can pursue what they love. This will also give your child the opportunity to be around children who share the same interests as they do, something they may not find on the school playground.
If after school camps do not interest you or your child, open their horizons to activities at home that extend beyond multimedia. Take out old board games, lay out art supplies and encourage them to run around outside when the sun is out. Exercise is important for children as well as adults and luckily, kids can get a good workout without them realizing it. Have a bike readily accessible for them to ride and make sure to have a helmet nearby! If you have a dog, make a routine of walking the dog with your child after school.
Learning that reading can be fun is also important for kids to learn at a young age. One day, take your child to your local book store and allow them to choose books that interest them. They may be used to having books already chosen for them at school. Set up a nice and inviting reading area in your house and you?ll be pleasantly surprised when your child wanders over there by themselves.

(AP) ? Hopes that the economy may emerge from its slump got a lift Tuesday from a report that Americans increased their spending at retailers in July by the most in five months.

From cars, electronics and sporting goods to furniture, building supplies and garden equipment, every major category of spending rose last month. It was a heartening start to the second half of the year after consumers had reduced their retail spending in each month of the April-June quarter.

Retail sales rose 0.8 percent from June to July, the Commerce Department said. It was the sharpest increase since February.

The stepped-up spending was evident in Home Depot's report Tuesday that its customers spent more on remodeling and repair projects in the second quarter. Those gains suggested that consumers are feeling more optimistic about the recovery of the housing market.

Americans appear to be taking their cue from the economy's modest but steady improvements.

Employers added 163,000 jobs in July, the best month for job growth since February. Home prices are up. The value of U.S. exports reached a record high last month. U.S. consumers are expressing more confidence. Stock indexes are near their highs for the year. And consumer confidence rose in July for the first time in five months.

"It looks like lower gas prices, a nice rally in stocks and stronger job growth ... helped boost consumer spending" in July said Jennifer Lee, senior economist at BMO Capital Markets.

Some economists cautioned that consumers will likely sustain their spending increases only if hiring continues to strengthen. In the meantime, many remain anxious about the job market and held back by slow wage gains and high debts.

"Americans are not throwing caution to the wind," said Chris Christopher, a senior economist at IHS Global Insight.

A brighter outlook for the economy might also make the Federal Reserve hesitant to take further action to boost growth when its policy committee meets in September.

Still, the overall economy remains subpar. It grew at an annual rate of just 1.5 percent from April through June. That's far too weak to lower the unemployment rate, which ticked up in July to 8.3 percent.

And inflation remains mild, which gives the Fed more leeway to act if it decides the economy needs further help. The Labor Department said in a separate report Tuesday that wholesale prices rose 0.3 percent in July from June. Lower energy prices offset sharp gains in the costs of food, cars and light trucks.

Wholesale prices increased only 0.5 percent in the 12 months that ended in July. That's the lowest since October 2009. Excluding food and energy costs, prices rose 2.5 percent in the 12 months that ended in July. It was the smallest year-over-year gain since June 2011.

The government's retail sales report is the government's first look each month at consumer spending, which drives roughly 70 percent of economic activity.

Overall, consumer spending on goods and services grew only 1.5 percent in the April-June quarter, the slowest pace in a year.

Americans are also saving more. The savings rate ? the portion of Americans' after-tax income that they don't spend ? rose to 4.4 percent in June, the highest in a year.

(AP) ? Evelyn Lozada is ending her 41-day-old marriage to Chad Johnson after the football star was arrested for allegedly head-butting her over the weekend.

A rep for the VH1 reality star confirmed reports that Lozada filed for divorce Tuesday.

"Given the recent events that have taken place, Evelyn has decided to file for divorce and move on with her life," Lozada's lawyer, Michael B. Gilden, told the TV show "The Insider" in a statement.

Johnson released his own statement ? the first since his arrest ? on his official website, OCNN, and reaffirmed his love for Lozada.

"I am going to let the legal process run its course. I wish Evelyn nothing but the best, I have no negative words to say about her, the only thing I can say is I love her very much," said Johnson, who was dumped by the Miami Dolphins a day after the arrest.

"I will continue to be positive and stay training hard for another opportunity in the NFL. I appreciate all my fans and supporters and if I have disappointed you in any way, you have my sincerest apologies. Once again I will continue to stay positive and appreciate all the support during this tough period in my life."

The marriage imploded Saturday after an argument between the two ended with Lozada being treated at a hospital for lacerations to her head.

According to Davie, Fla., police, Lozada found a receipt for condoms and confronted Johnson about it at dinner. The argument continued during their drive home, and when they arrived at their driveway, he allegedly head-butted her.

In a 911 call released by authorities, a neighbor told police that there was an incident involving a "high-profile person" and is heard telling Lozada to wipe the blood from her head. Lozada is heard saying that Johnson head-butted her, and the caller says Lozada will probably need stitches.

However, Johnson told police she head-butted him.

Earlier Tuesday, Lozada said in a statement: "I am deeply disappointed that Chad has failed to take responsibility for his actions and made false accusations against me, it is my sincere hope that he seeks the help he needs to overcome his troubles. Domestic violence is not okay and hopefully my taking a stand will help encourage other women to break their silence as well."

However, Lozada has been prone to violence: On the VH1 series "Basketball Wives," where she gained her fame, she became infamous for attacks on other castmates. In June, she apologized for her behavior and in a letter to her younger self posted on The Huffington Post, she blamed her penchant for fighting on violence in her own household growing up.

Johnson is a six-time Pro Bowler who last season was on the New England Patriots. His July 4 wedding to Lozada ? whom he courted publicly on "Basketball Wives" ? was taped for a spinoff show called "Ev & Ocho." It was due to debut Sept. 3, but VH1 shelved it after Johnson's weekend arrest.

Johnson ? formerly known as Chad Ochocinco ? and Lozada were prominently featured in the recent first episode of HBO's "Hard Knocks: Training Camp with the Miami Dolphins."

Lozada was the former fiancee of former NBA player Antoine Walker and has been one of the main stars of "Basketball Wives," which also features Shaunie O'Neal, the former wife of former NBA star Shaquille O'Neal.

In court papers filed on Tuesday, Lozada says the two had a premarital agreement but asks Johnson pay for her attorney fees associated with the divorce.

Besides ending her marriage, Lozada also was mourning the loss of her brother-in-law, who walked her down the aisle and was to be a part of the "Ev & Ocho" show.

Home Depot sees rosier year ahead as profit climbs | Business ...

ATLANTA (AP) ? The Home Depot Inc. is feeling more optimistic about the recovery of the housing market after customers spent more on remodeling and repair projects in the second quarter.

The country's biggest home-improvement retailer said Tuesday that stronger sales of paint, bath accessories and kitchen installations helped lift its net income by 12 percent during the period. Lower costs also contributed to the improved results.

The Atlanta-based company boosted its full-year earnings outlook, citing its performance so far this year.

Chairman and CEO Frank Blake noted in a conference call with investors that some of the strongest growth came from the markets that were hit hardest in the downturn, such as California and Florida.

"These are encouraging signs of stabilization in the housing market," Blake said.

When the housing market is weak, companies such as Home Depot struggle because new construction slows and contractors don't spend as much on supplies. Homeowners also pull back on projects, such as kitchen or bathroom renovations.

In the latest quarter, however, Home Depot said it saw signs of improvements in key areas.

Overall, revenue at stores open at least a year rose 2.1 percent. In the U.S., where the majority of Home Depot's stores are located, the figure rose 2.6 percent. The metric is a key gauge of a retailer's health because it strips out the impact of recently opened or closed locations.

Sales of spray paint, laminated flooring and area rugs saw double-digit sales growth, the company said. Sales of paint, bath accessories, special order carpeting, window treatments and wood flooring also improved.

Transactions of $900 or more, which make up about 20 percent of U.S. sales, rose 3.4 percent in the quarter, as appliance, kitchen and flooring sales increased. Transactions of $50 or less, which also make up about 20 percent of sales, were down 0.7 percent.

The company attributed the decline to the warm winter, which it said pulled sales of seasonal items, such as gardening products, into the first quarter.

Home Depot's total operating expenses also eased to $4.46 billion during the quarter, down 3 percent from a year ago. The improvement was partly the result of a new regulation that caps the amount banks can charge retailers when customers pay with debit cards.

In the second half of the year, however, Home Depot expects expenses to rise as it spends on new call centers and other operational improvements.

Looking ahead, Home Depot now expects fiscal 2012 earnings of $2.95 per share, up from the $2.90 per share it previously forecast. Sales are still expected to rise 4.6 percent, implying revenue of $73.63 billion.

Analysts expect earnings of $2.92 per share on revenue of $73.95 billion.

Home Depot runs more than 2,200 stores. Its smaller rival Lowe's Cos. reports its earnings Monday.

Shares of Home Depot rose $1.60, or 3 percent, to $54.42 in morning trading.
